Can a foreign national inherit a Shenzhen property?
Inheritance eligibility and title transfer are separate questions. Civil Code Article 1120 protects the right of natural persons to inherit, while Articles 1121 to 1124 define when inheritance begins, what forms the estate, the relationship between wills and statutory succession, and acceptance or renunciation. Nationality alone does not complete the proof or registration process.
Start with four layers: the people and status records, the succession basis, the property and debts, and the receiving procedure. This prevents an overseas will, kinship certificate or notarial document from being mistaken for a completed Shenzhen title transfer.
Which law applies to Shenzhen real estate succession?
Governing law is the rule system used to decide the succession issue. Article 31 of the Law on the Application of Laws to Foreign-Related Civil Relations states that statutory succession generally applies the law of the deceased's habitual residence at death, but statutory succession to immovable property applies the law where the property is located.
