Can a foreign judgment be enforced directly in Guangdong?
Recognition is the Chinese court's gateway determination that a foreign judgment may have legal effect in China; enforcement is the later use of compulsory measures against property. Civil Procedure Law Article 298 allows a party to apply directly to the competent intermediate people's court, or a foreign court to request recognition and enforcement under an international treaty or reciprocity.
The application must therefore identify a qualifying effective judgment, the legal basis for recognition and a competent Chinese court. A foreign judgment bearing a seal is not itself a Chinese enforcement title, and this article does not promise recognition.
Which Guangdong court should receive the application?
The receiving court is generally an intermediate people's court connected to the respondent or executable property under the foreign-judgment provisions and applicable judicial rules. A Shenzhen company, residence or asset may establish a Guangdong connection, but the exact intermediate court and court-level allocation require fact-specific confirmation.
