What is cross-border online filing in China?
Cross-border online filing is a judicial service for parties outside mainland China to complete specified filing steps through an online court channel. The Supreme People's Court Provisions on Providing Online Case Filing Services for Parties to Cross-border Litigation define the service to include guidance, legal queries, online video witnessing and filing registration for foreign persons, Hong Kong, Macao and Taiwan residents, and mainland citizens habitually residing abroad.
Article 2 limits the Provisions to first-instance civil and commercial litigation. The service is therefore not a promise that every case type, appeal, enforcement application or administrative matter can use the same path. Counsel must classify the proceeding before creating an online-filing checklist.
What must be decided before opening the online portal?
Jurisdiction is the threshold decision that identifies the court legally authorised to receive the claim. Online filing does not create jurisdiction. Review the defendant, claim type, contract or arbitration clause, domicile, place of performance, asset location and any exclusive or special jurisdiction before selecting a court.
The filing pack should state why that court is competent and identify the supporting document for each jurisdiction fact. How does an overseas individual pass identity verification?
Identity verification is the court's confirmation that the online user is the actual litigant or authorised participant. Under Article 4, the court conducts online identity verification mainly by comparing identity documents and identity proof, and should provide verification feedback within three working days after receiving the application.
Prepare a clear, valid passport or other accepted identity document, consistent name spellings, date of birth and contact details. A statutory feedback period is not an overall case-filing promise; unclear scans, inconsistent transliteration or additional proof requests may still require correction.
What must a foreign enterprise prove?
Enterprise identity proof is the chain showing that an overseas entity legally exists and that the participant can act for it. Article 5 requires identity documents and proof that the participant acts as representative; it states notarisation and Chinese embassy or consulate authentication requirements unless an applicable treaty provides otherwise.
The required set may include an incorporation or registry record, current status, constitutional or incumbency records, representative proof, corporate approval and the representative's identity. Since China and many jurisdictions may use treaty-based Apostille procedures, the candidate deliberately leaves the country-specific form as a lawyer placeholder rather than repeating an obsolete universal legalisation rule.
Can a PRC lawyer's power of attorney be witnessed online?
Online video witnessing is a court-hosted method of confirming a cross-border litigant's appointment of a PRC lawyer. Article 6 allows a judge and an online interpreter to witness the signing of a power of attorney after identity verification. The rule states that the witnessed power need not undergo notarisation, authentication or other forwarding procedures.
The process record is retained online, and the instrument should comply with Article 8's content requirements. Availability, scheduling, identity compatibility and current platform workflow must still be confirmed with the receiving court. Do not assume that a private video call with counsel has the same legal effect.
Which documents are uploaded with the filing?
The filing bundle is the complaint plus the documents proving parties, authority, jurisdiction, facts and requested relief. Article 7 identifies the complaint, identity documents, evidence and other filing materials and requires Chinese translations for foreign-language documents. Article 8 addresses the power of attorney's authorised matters and scope.
Use a numbered index with a short purpose statement for every exhibit. Preserve original files, metadata and paper originals outside the portal. The SPC Evidence Provisions treat email and instant messaging as electronic data and require orderly classification; a screenshot alone may omit the information needed to test authenticity.
What happens if the filing is incomplete?
A correction notice is the court's request for missing or non-compliant filing material. Article 9 provides a 15-day period for supplementation or correction and permits an extension to 30 days when the party has genuine difficulty. It also specifies how the court handles filings after review.
Treat the notice as a legal task list, not merely a portal error. Record its issue date, each item requested, the evidence needed, translation responsibility and upload confirmation. Statutory language should be rechecked against the notice and the actual platform before calculating a deadline.
Does online filing eliminate overseas document formalities?
Digitisation changes delivery, not the evidentiary status of the underlying document. Corporate identity, foreign public documents, foreign-language evidence and an overseas power of attorney may still require specified proof. Article 6 creates a focused exception for a power witnessed through the court's process; it does not authenticate every exhibit uploaded in the case.
