If a Hong Kong document must go to a Mainland court, bank or registry, start with its purpose and recipient before choosing an attesting officer, notary, Mainland institution or PRC lawyer.

1. Route by origin, use and receiving body

A China-Appointed Attesting Officer is an eligible Hong Kong lawyer commissioned by the PRC Ministry of Justice to attest Hong Kong acts, facts and documents for Mainland use. The role is not a Mainland notary and not every Hong Kong international notarisation is interchangeable. 2. Four different roles

Hong Kong Cap. 159 regulates Hong Kong solicitors and notaries; a China-Appointed Attesting Officer is a further Mainland-use commission. The PRC Notary Law governs Mainland notarial institutions and notaries, while the PRC Lawyers Law governs PRC-qualified lawyers. 3. The Hong Kong attestation-transfer chain

The Association’s current procedure sends the officer’s document to China Legal Services (H.K.) Limited for examination, sealing and transfer. 4. Mainland acceptance, verification and 15 working days

A Mainland application normally follows domicile, habitual residence, place of act or fact, subject to special immovable-property rules. Applicants must explain truthfully and provide authentic, lawful and sufficient material; the institution verifies identity, intention, content and legality. 5. Current Shenzhen Mainland notarial fee ceilings

The official schedule effective 1 January 2022 lists RMB430 per natural-person power of attorney, declaration or guarantee; RMB120 for specified personal facts including birth, death, identity, education, marriage, relationship, property, income, tax and no-criminal-record; and RMB80 for specified certificate, signature, date and copy/translation conformity matters. The schedule provides two certificates; each additional copy is RMB20. Listed rates are ceilings and institutions may charge less. Unlisted services may be market-priced. 6. Evidence use in a PRC court

A valid notarised fact may be exempt from proof unless rebutted. Hong Kong-formed evidence must complete the relevant proof formalities; foreign-language documentary evidence needs a Chinese translation. Notarisation does not guarantee acceptance of every statement or replace relevance, legality and weight analysis.

7. Court-to-court service is not notarisation

The operative 1999 Mainland-Hong Kong service arrangement requires Chinese text, two copies for each of two or more recipients, a general two-month completion period and mutual waiver of ordinary service fees.
