Four Routes for a Hong Kong–Mainland Consumer Dispute

彭子镔 Peng Zibin · Lawyer, Beijing Dongyuan Law Firm, Shenzhen Office

Published · · Updated ·

Separate trader negotiation, Consumer Council referral, Mainland administrative complaint, and arbitration or litigation.

Direct answer: Preserve the order, payment, promise, delivery and complaint records, identify the Mainland operator by its registered name, and choose among negotiation, cross-border referral, a complaint to the competent Mainland regulator, arbitration or litigation. A referral channel does not itself create an enforceable decision.

Direct answer: Preserve original transaction evidence

This is general legal information, not matter-specific advice. A complaint being accepted, a mediation succeeding, and obtaining an enforceable instrument are different events. The four routes have different targets, powers, evidence and deadlines. (Sources: PRC Law on the Protection of Consumer Rights and Interests, Articles 37, 39, 40 and 55 (Official text: https://www.samr.gov.cn/zfjcj/tzgg/art/2023/art_615af9ed6bcd4974bf853dd2e02bc663.html); Hong Kong Consumer Council official complaint and cross-border referral guidance (Official text: https://www.consumer.org.hk/tc/complaints-and-services))

  • Preserve original transaction evidence
  • Map four complaint and recovery routes
  • Consumer Council referral is not Mainland enforcement

1. Negotiate in writing with the actual trader

Verify the trader name, registration number, platform role, payee and performer. State facts, promise, relief and a response date in a retained notice. (Sources: PRC Law on the Protection of Consumer Rights and Interests, Articles 37, 39, 40 and 55 (Official text: https://www.samr.gov.cn/zfjcj/tzgg/art/2023/art_615af9ed6bcd4974bf853dd2e02bc663.html); SPC Provisions on Evidence in Civil Proceedings, Articles 14, 16, 17 and 19 (electronic data, overseas-formed evidence and foreign-language materials) (Official text: https://www.court.gov.cn/zixun/xiangqing/212721.html))

  • Exact trader identity
  • Order, payment and promise
  • Refund, repair, replacement or performance

2. Use Hong Kong Consumer Council referral where eligible

The Council may refer eligible cross-border complaints under cooperation mechanisms and conciliate. Its guidance says it is not an enforcement body and has no investigation or adjudication power. (Sources: Hong Kong Consumer Council official complaint and cross-border referral guidance (Official text: https://www.consumer.org.hk/tc/complaints-and-services))

  • Consumer matters within remit
  • Trader and transaction details
  • Outcome depends on cooperation

3. Complain to the responsible Mainland authority

The implementing regulation requires true identity, a clear respondent, specific request and factual basis. The authority decides acceptance and may mediate with both parties’ consent. (Sources: PRC Regulation for Implementing the Consumer Rights Protection Law, Articles 43 to 49 (effective 1 July 2024) (Official text: https://xzfg.moj.gov.cn/front/law/detail?LawID=1708))

  • Correct authority and locality
  • Named respondent and relief
  • Keep acceptance records

4. Arbitrate or litigate when an enforceable result is needed

The statute lists negotiation, mediation, complaint, arbitration under an agreement, and litigation. Arbitration needs a valid clause. Litigation needs the exact court, defendant address, quantified relief and evidence. A complaint should not be assumed to pause limitation. (Sources: PRC Law on the Protection of Consumer Rights and Interests, Articles 37, 39, 40 and 55 (Official text: https://www.samr.gov.cn/zfjcj/tzgg/art/2023/art_615af9ed6bcd4974bf853dd2e02bc663.html); PRC Civil Procedure Law, Articles 24, 35, 276 and 277 (contract and foreign-related jurisdiction) (Official text: https://flk.npc.gov.cn/detail?id=ff8081818a21dc13018b425303b7086d); PRC Civil Code, Articles 188 and 195 (general limitation and interruption) (Official text: https://flk.npc.gov.cn/detail?id=ff808081729d1efe01729d50b5c500bf))

  • Check dispute clause
  • Identify exact court
  • Track limitation separately

5. Prove platform, trader and payment roles separately

A platform page, payee and customer service account may be different entities. Map the seller, service provider, platform, brand and payment channel. Preserve goods, batch, repair and testing chain for quality disputes. (Sources: PRC Law on the Protection of Consumer Rights and Interests, Articles 37, 39, 40 and 55 (Official text: https://www.samr.gov.cn/zfjcj/tzgg/art/2023/art_615af9ed6bcd4974bf853dd2e02bc663.html); PRC Regulation for Implementing the Consumer Rights Protection Law, Articles 43 to 49 (effective 1 July 2024) (Official text: https://xzfg.moj.gov.cn/front/law/detail?LawID=1708); SPC Provisions on Evidence in Civil Proceedings, Articles 14, 16, 17 and 19 (electronic data, overseas-formed evidence and foreign-language materials) (Official text: https://www.court.gov.cn/zixun/xiangqing/212721.html))

  • Responsibility matrix
  • Do not discard goods or packaging
  • Preserve samples before testing

6. Scale spending to value and enforceability

Compare amount, proof, trader solvency, testing, translation, service and attendance. Use lower-cost complaint routes for appropriate small disputes and assess litigation for larger loss or injury. (Sources: Measures for the Payment of Litigation Costs, Articles 6 and 12 (case acceptance and specified application or appraisal costs) (Official text: https://flk.npc.gov.cn/detail?id=ff8080816f3e98bd016f41e1395a015f); Opinions on Further Regulating Lawyers’ Service Fees, Sifa Tong [2021] No. 87, Items 8, 9 and 16 (Official text: https://www.moj.gov.cn/pub/sfbgwapp/zwgk/tzggApp/202203/t20220324_451433.html))

  • Claim value and alternatives
  • Testing, translation and court costs
  • Assets and enforcement

The verification pack to send counsel

Send a one-page chronology, party details, a core-document index, an amount or asset schedule, and the three questions you need answered. Add the remaining material after counsel identifies the decisive gaps.

  • Order and trader identity
  • Payment, delivery and goods evidence
  • Advertising and full service chats
  • Complaint channels, references and desired outcome

How this guide differs from related articles

This article is for personal consumption. A Hong Kong company’s commercial receivable belongs in the business debt-recovery guide; consumer rules should not be transplanted into company procurement.
